Article R334-1-2 of the French Insurance Code

The Autorité de contrôle may not refuse a reinsurance contract entered into by an insurance undertaking referred to in 1° of Article L. 310-2 with an insurance undertaking referred to in 1° of Article L. 310-2 or a reinsurance undertaking referred to in 1° of Article L. 310-1-2 or with another insurance or reinsurance undertaking whose head office is in another Member State or another State party to the European Economic Area, on grounds directly related to the financial soundness of that insurance or reinsurance undertaking.

L’Autorité de contrôle ne peut refuser un contrat de réassurance conclu par une entreprise d’assurance mentionnée au 1° de l’article L. 310-2 avec une entreprise d’assurance mentionnée au 1° de l’article L. 310-2 ou de réassurance mentionnée au 1° de l’article L. 310-1-2 ou avec une autre entreprise d’assurance ou de réassurance ayant son siège social dans un autre Etat membre ou un autre Etat partie à l’Espace économique européen, pour des motifs directement liés à la solidité financière de cette entreprise d’assurance ou de réassurance.
