Article R342-21 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the foreign national is held at the disposal of the courts, the public prosecutor decides on the conditions of the holding. He shall inform the foreign national and the administrative authority that ordered the foreign national to be held in the waiting area of this without delay.

Lorsque l’étranger est maintenu à la disposition de la justice, le procureur de la République décide des conditions du maintien. Il en informe sans délai l’étranger et l’autorité administrative qui a prononcé le maintien en zone d’attente.
