Where the Autorité de contrôle prudentiel et de résolution temporarily suspends, restricts or prohibits the free disposal of all or part of the assets of an undertaking pursuant to Article L. 612-33 (4) of the Monetary and Financial Code, and where such measure is taken because the insurance or reinsurance undertaking does not comply with the provisions of Section 2 of Chapter I of this Title, it shall first inform the supervisory authorities of the host Member States concerned.
Where the Autorité de contrôle prudentiel et de résolution temporarily suspends, restricts or prohibits the free disposal of all or part of the assets of an undertaking pursuant to Article L. 612-33(4) of the Monetary and Financial Code, and where this measure is taken because, in exceptional circumstances, the Autorité considers that the financial situation of the undertaking concerned will continue to deteriorate despite the measures referred to in the third paragraph of Article L. 352-7, it shall first inform the supervisory authorities of the host Member States concerned and ask them to take the same measures.
When the Autorité de contrôle prudentiel et de résolution temporarily suspends, restricts or prohibits the free disposal of all or part of the assets of an undertaking pursuant to Article L. 612-33(4) of the Monetary and Financial Code, and when this measure is taken when the Minimum Capital Requirement no longer complies with the provisions of Article L. 352-5, or when there is a risk that it will no longer do so within the next three months, it shall first inform the supervisory authorities of the host Member States concerned and ask them to take the same measures.
