Article R352-32 of the French Insurance Code

The application referred to in the fifth paragraph of Article L. 352-7 shall be made if the following conditions are met:

a) It is unlikely that insurance or reinsurance undertakings representing a significant share of the market or of the lines of business affected will be able to meet the requirements referred to in the fourth paragraph of Article L. 352-7 ;

b) The financial situation of insurance or reinsurance undertakings representing a significant share of the market or of the lines of business affected is subject to the serious or detrimental effects of an unforeseen, sharp and abrupt fall in the financial markets, or of a lasting context of low interest rates, or of a catastrophic event with serious repercussions.

La demande visée au cinquième alinéa de l’article L. 352-7 est effectuée si les conditions suivantes sont réunies :

a) Il est improbable que des entreprises d’assurance ou de réassurance représentant une part significative du marché ou des lignes d’activité affectées puissent respecter les exigences mentionnées au quatrième alinéa de l’article L. 352-7 ;

b) La situation financière d’entreprises d’assurance ou de réassurance représentant une part significative du marché ou des lignes d’activité affectées subit les effets graves ou préjudiciables d’une baisse imprévue, prononcée et abrupte des marchés financiers, ou d’un contexte durable de faibles taux d’intérêt, ou d’un évènement catastrophique porteur de graves incidences.
