In implementing the provisions of Articles R. 356-52 and R. 356-53, the Autorité de contrôle prudentiel et de résolution shall assess whether the provision of information represents a disproportionate burden for the groups, having regard to the nature, scale and complexity of the risks to which the group is exposed, taking into account at least :
(a) the volume of premiums, technical provisions and assets of the group;
(b) the volatility of claims and settlements covered by the undertakings in the group;
(c) the market risks to which the investments of the undertakings in the group give rise;
(d) the level of risk concentration;
e) the potential effects of the management of the Group’s assets on financial stability;
f) the systems and structures at Group level enabling it to communicate information for control purposes and the written policy guaranteeing the permanent adequacy of this information;
g) the adequacy of the system of governance at Group level;
h) the level of own funds covering the Solvency Capital Requirement and the Minimum Capital Requirement.
