Article R356-53 of the French Insurance Code

Pursuant to the sixth paragraph of II of Article L. 356-21, the Autorité de contrôle prudentiel et de résolution in its capacity as group supervisor may, after consultation with the members of the college of supervisors, limit or waive the regular provision of line-by-line information at group level where :

(a) The provision of such information would represent a disproportionate burden taking into account the nature, scale and complexity of the risks inherent in the group’s business;

(b) The provision of such information is not necessary for the effective supervision of the group;

(c) The exemption does not undermine the stability of the financial systems concerned in the Union; and

(d) The group is able to provide information on an ad hoc basis.

En application du sixième alinéa du II de l’article L. 356-21, l’Autorité de contrôle prudentiel et de résolution en tant que contrôleur de groupe peut, après consultation des membres du collège des contrôleurs, limiter ou dispenser de la communication régulière d’informations ligne à ligne au niveau du groupe, lorsque :

a) La fourniture de ces informations représenterait une charge disproportionnée compte tenu de la nature, de l’ampleur et de la complexité des risques inhérents à l’activité du groupe ;

b) La fourniture de ces informations n’est pas nécessaire au contrôle effectif du groupe ;

c) La dispense ne nuit pas à la stabilité des systèmes financiers concernés dans l’Union ; et

d) Le groupe est en mesure de fournir des informations de façon ad hoc.
