Article R364-1 of the French Insurance Code

Where the Autorité de contrôle has required an insurance or reinsurance undertaking to submit a recovery plan in accordance with Article L. 612-32 of the Monetary and Financial Code , and that undertaking proposes to take over all or part of the portfolio of an undertaking having its head office in another Member State or another State party to the Agreement on the European Economic Area, it shall refrain from communicating to the competent authorities the solvency certificate necessary for them to approve the portfolio transfer.

Lorsque l’Autorité de contrôle a exigé d’une entreprise d’assurance ou de réassurance un programme de rétablissement conformément à l’ article L. 612-32 du code monétaire et financier , et que cette entreprise se propose de reprendre tout ou partie du portefeuille d’une entreprise ayant son siège social dans un autre Etat membre ou un autre Etat partie à l’accord sur l’Espace économique européen, elle s’abstient de communiquer aux autorités compétentes le certificat de solvabilité nécessaire pour qu’elles puissent approuver le transfert de portefeuille.
