I. – In order to combat the spread of diseases, the High Commissioner of the Republic shall take the following measures, after obtaining the opinion of the authorities in charge of health control in New Caledonia:
1° Measures to keep people affected in health establishments or any other suitable place in isolation within the meaning of Article 1 of the International Health Regulations;
2° Measures aimed at quarantining, within the meaning of Article 1 of the International Health Regulations, persons likely to be affected at home or in any other suitable accommodation.
II. – The High Commissioner of the Republic may prescribe the measures mentioned in 2° of I, by a reasoned order issued after consulting the authorities in charge of health control in New Caledonia when the following conditions are met:
1° The person has been diagnosed as a carrier of a serious contagious disease ;
2° The person has refused, in whole or in part, health care appropriate to their state of health, in particular isolation and treatment, despite repeated requests from health professionals and health services.
III. – The quarantine measures mentioned in 2° of I, within a military point of entry, are prescribed by the High Commissioner of the Republic, after obtaining the opinion of the manager of the said point of entry when they concern a person who has entered the territory via a military point of entry.
The quarantine measures referred to in 2° of I are prescribed by the High Commissioner of the Republic, after informing the Minister of Defence, when they concern a military means of transport, or a means of transport specifically chartered by the military authority, which is not stationed at a military point of entry.
