Article R385-21 of the French Insurance Code

Supplementary occupational pension funds may decide to publish in the report on their solvency and financial position referred to in Article L. 385-7 any information or explanations relating to their solvency and financial position other than those already required to be published pursuant to Articles L. 385-7 and R. 385-18 to R. 385-20, under the conditions specified by Article 298 of Commission Delegated Regulation (EU) 2015/35 of 10 October 2014 supplementing Directive 2009/138/EC of the European Parliament and of the Council on the taking-up and pursuit of the business of insurance and reinsurance (Solvency II) in the version in force on the date of publication of Decree 2017-1171 of 18 July 2017 laying down the rules applicable to supplementary occupational pension funds.

Les fonds de retraite professionnelle supplémentaire peuvent décider de publier dans le rapport sur la solvabilité et la situation financière mentionné à l’article L. 385-7 toutes informations ou explications relatives à leur solvabilité et à leur situation financière autres que celles dont la publication est déjà exigée en application des articles L. 385-7 et R. 385-18 à R. 385-20, dans des conditions précisées par l’article 298 du règlement délégué (UE) 2015/35 de la Commission du 10 octobre 2014 complétant la directive 2009/138/CE du Parlement européen et du Conseil sur l’accès aux activités de l’assurance et de la réassurance et leur exercice (Solvabilité II) dans sa rédaction en vigueur à la date de publication du décret n° 2017-1171 du 18 juillet 2017 fixant les règles applicables aux fonds de retraite professionnelle supplémentaire.
