Article R4112-9 of the French Public Health Code

The declaration provided for in Article L. 4112-7 must be sent to the Conseil national de l’ordre of the profession concerned before the first services are provided.

It includes information relating to civil status, nationality, initial training, professional experience and lifelong training that has been validated by a competent body, language skills, the legality of the establishment in the Member State of origin or provenance, the absence of any ban, even temporary, on practising, professional qualifications, professional insurance and the place of performance of the first provision of services, as well as a list of the supporting documents that accompany it.

The temporary and occasional nature of the provision of services is assessed on a case-by-case basis, in particular according to its duration, frequency, periodicity and continuity.

La déclaration prévue à l’article L. 4112-7 est adressée avant la première prestation de services au Conseil national de l’ordre de la profession concernée.

Elle comporte des informations relatives à l’état civil, à la nationalité, à la formation initiale, à l’expérience professionnelle et à la formation tout au long de vie ayant fait l’objet d’une validation par un organisme compétent, aux connaissances linguistiques, à la légalité de l’établissement dans l’Etat membre d’origine ou de provenance, à l’absence d’interdiction, même temporaire, d’exercer, aux qualifications professionnelles, à l’assurance professionnelle et au lieu d’exécution de la première prestation de services, ainsi que la liste des pièces justificatives qui l’accompagnent.

Le caractère temporaire et occasionnel de la prestation de services est apprécié au cas par cas, notamment en fonction de sa durée, de sa fréquence, de sa périodicité et de sa continuité.
