Article R412-28 of the French Consumer Code

The enforcement measures provided for in Article L. 412-1 :
1° The provisions of points 1 and 2 of Chapter IV, 1 and 2 of Section IX “Raw milk, colostrum, milk products and colostrum-based products” of Annex III of Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004, as amended, laying down specific hygiene rules for food of animal origin;
2° The provisions of Articles 1 to 3 of Commission Regulation (EC) No 445/2007 of 23 April 2007 laying down certain detailed rules for applying Council Regulation (EC) No 2991/94 laying down standards for spreadable fats and Council Regulation (EEC) No 1898/87 on the protection of designations used in marketing milk and milk products and its annexes;
3° The provisions of Article 78 and of Annex VII, Parts III “Milk and milk products” and IV “Milk intended for human consumption falling within CN code 0401” of Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013, as amended, on the common organisation of the markets in agricultural products for the products defined in Part XVI of Annex I to that Regulation ;
4° The provisions of Articles 75 and 78 and Annex VII, Part VII “Spreadable fats” of Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 as amended on the common organisation of agricultural markets.

Constituent les mesures d’exécution prévues à l’article L. 412-1 :
1° Les dispositions des points 1 et 2 du chapitre IV, les 1 et 2 de la section IX ” Lait cru, colostrum, produits laitiers et produits à base de colostrum ” de l’annexe III du règlement (CE) n° 853/2004 du Parlement et du Conseil du 29 avril 2004 modifié fixant des règles spécifiques d’hygiène applicable à des denrées alimentaires d’origine animale ;
2° Les dispositions des articles 1er à 3 du règlement (CE) n° 445/2007 de la Commission du 23 avril 2007 portant certaines modalités d’application du règlement (CE) n° 2991/94 du Conseil établissant des normes pour les matières grasses tartinables et du règlement (CEE) n° 1898/87 du Conseil concernant la protection de la dénomination du lait et des produits laitiers lors de leur commercialisation de ses annexes ;
3° Les dispositions de l’article 78 et de l’annexe VII, parties III ” Lait et produits laitiers ” et IV ” Lait destiné à la consommation humaine relevant du code NC 0401 ” du règlement (UE) n° 1308/2013 du Parlement européen et du Conseil du 17 décembre 2013 modifié portant organisation commune des marchés des produits agricoles pour les produits définis à la partie XVI de l’annexe I de ce règlement ;
4° Les dispositions des articles 75 et 78 et de l’annexe VII, partie VII ” Matières grasses tartinables ” du règlement (UE) n° 1308/2013 du Parlement européen et du Conseil du 17 décembre 2013 modifié portant organisation commune des marchés des produits agricoles.
