Article R412-38 of the French Consumer Code

The enforcement measures provided for in Article L. 412-1 :

1° The provisions of Articles 1 to 5 and 15 to 17 of Regulation (EC) No 1935/2004 of the European Parliament and of the Council of 27 October 2004 on materials and articles intended to come into contact with foodstuffs;

> The provisions of Articles 1 to 5 and 15 to 17 of Regulation (EC) No 1935/2004 of the European Parliament and of the Council of 27 October 2004 on materials and articles intended to come into contact with foodstuffs
2° the provisions of Articles 1 to 5 of Commission Regulation (EC) No 1895/2005 of 18 November 2005 on the restriction of the use of certain epoxy derivatives in materials and articles intended to come into contact with foodstuffs;

3° The provisions of Articles 1 to 7 of amended Commission Regulation (EC) No 2023/2006 of 22 December 2006 on good manufacturing practice for materials and articles intended to come into contact with food and its Annex;

> The provisions of Articles 2 and 3 of Commission Regulation (EC) No 2023/2006 of 22 December 2006 on good manufacturing practice for materials and articles intended to come into contact with food and its Annex
4° the provisions of Articles 2 and 3 of Commission Regulation (EC) No 282/2008 of 27 March 2008 on recycled plastic materials and articles intended to come into contact with foodstuffs and amending Regulation (EC) No 2023/2006;

the provisions of Articles 4, 5, 6 and 7 of Commission Regulation (EC) No 282/2008 of 27 March 2008 on recycled plastic materials and articles intended to come into contact with foodstuffs and amending Regulation (EC) No 2023/2006
5° The provisions of Articles 4, 5 and 11 to 13 of Commission Regulation (EC) No 450/2009 of 29 May 2009 on active and intelligent materials and articles intended to come into contact with foodstuffs;

> The provisions of Articles 2 to 6 of Commission Regulation (EC) No 450/2009 of 29 May 2009 on active and intelligent materials and articles intended to come into contact with foodstuffs
6° The provisions of Articles 2 to 6 and 8 to 19 of Commission Regulation (EU) No 10/2011 of 14 January 2011 on plastic materials and articles intended to come into contact with foodstuffs.

Constituent les mesures d’exécution prévues à l’article L. 412-1 :


1° Les dispositions des articles 1er à 5 et 15 à 17 du règlement (CE) n° 1935/2004 du Parlement européen et du Conseil du 27 octobre 2004 concernant les matériaux et objets destinés à entrer en contact avec des denrées alimentaires ;


2° Les dispositions des articles 1er à 5 du règlement (CE) n° 1895/2005 de la Commission du 18 novembre 2005 concernant la limitation de l’utilisation de certains dérivés époxydiques dans les matériaux et objets destinés à entrer en contact avec des denrées alimentaires ;


3° Les dispositions des articles 1er à 7 du règlement (CE) n° 2023/2006 de la Commission du 22 décembre 2006 modifié relatif aux bonnes pratiques de fabrication des matériaux et objets destinés à entrer en contact avec des denrées alimentaires et de son annexe ;


4° Les dispositions des articles 2 et 3 du règlement (CE) n° 282/2008 de la Commission du 27 mars 2008 relatif aux matériaux et aux objets en matière plastique recyclée destinés à entrer en contact avec des denrées alimentaires et modifiant le règlement (CE) n° 2023/2006 ;


5° Les dispositions des articles 4, 5 et 11 à 13 du règlement (CE) n° 450/2009 de la Commission du 29 mai 2009 concernant les matériaux et aux objets actifs et intelligents destinés à entrer en contact avec des denrées alimentaires ;


6° Les dispositions des articles 2 à 6 et 8 à 19 du règlement (UE) n° 10/2011 de la Commission du 14 janvier 2011 concernant les matériaux et objets en matière plastique destinés à entrer en contact avec des denrées alimentaires.
