Article R4134-18 of the French General Code of Local Authorities

The regional economic, social and environmental council may comprise one or two sections.

In addition to the members of the regional economic, social and environmental council appointed under conditions laid down in its rules of procedure, leading figures from outside the council may be appointed as members of the sections, up to a limit of one third of the total membership of each section.

The number and areas of competence of the sections, as well as the number of their members, including that of the external personalities, are set, on a proposal from the regional economic, social and environmental council, by an order of the regional prefect.

External members are appointed by the President of the Regional Economic, Social and Environmental Council on the basis of their expertise, after consulting the Bureau and the President of the Regional Council. An order of the regional prefect records these appointments.

The president of the regional economic, social and environmental council, after obtaining the opinion of the bureau, notifies the presidents of the sections of the requests for opinions intended for them. He forwards the opinions and reports drawn up by the section, together with the opinion of the regional economic, social and environmental council, to the competent authority.

Subject to the provisions of article R. 4134-19, the term of office of the members of a section is three years. It expires at the same time as that of the members of the bureau. The term of office is renewable.

Article R4134-18

Le conseil économique, social et environnemental régional peut comprendre une ou deux sections.

Outre des membres du conseil économique, social et environnemental régional désignés dans des conditions prévues par son règlement intérieur, des personnalités extérieures au conseil peuvent être désignées comme membres des sections, dans la limite du tiers de l’effectif total de chaque section.

Le nombre et les domaines de compétence des sections ainsi que le nombre de leurs membres, dont celui des personnalités extérieures, sont fixés, sur proposition du conseil économique, social et environnemental régional, par un arrêté du préfet de région.

Les personnalités extérieures sont désignées, en raison de leurs compétences, par le président du conseil économique, social et environnemental régional, après avis du bureau et après consultation du président du conseil régional. Un arrêté du préfet de région constate ces désignations.

Le président du conseil économique, social et environnemental régional, après avis du bureau, notifie aux présidents des sections les demandes d’avis destinées à celles-ci. Il transmet à l’autorité compétente les avis et les rapports établis par la section, accompagnés de l’avis du conseil économique, social et environnemental régional.

Sous réserve des dispositions de l’article R. 4134-19, la durée du mandat des membres d’une section est de trois ans. Il expire en même temps que celui des membres du bureau. Le mandat est renouvelable.
