Article R421-60 of the French Insurance Code

Subject to the limits and conditions laid down by the legislative and regulatory provisions referred to in article L. 421-10 and articles R. 421-58 and R. 421-59, the guarantee fund shall pay compensation due to victims of accidents occurring in the territories referred to in article R. 421-58.

However, the following are not covered

a) Damage caused by land motor vehicles for which road insurance is not compulsory under the regulations of these territories;

b) Damage caused by an identified perpetrator who has complied with the insurance obligation in force in the territory in question and which would not be covered by the guarantee fund in mainland France if the insurance obligation had been complied with there.

Derogations from the provisions of b above may be authorised by joint order of the Minister for Overseas Departments and Territories and the Minister for the Economy and Finance, depending on the particular conditions of motor traffic or the system of compensation for victims of motor vehicle accidents in the above-mentioned overseas territories.

Coverage by the guarantee fund applies only to the consequences of accidents occurring after the date of entry into force provided for in article R. 421-63.

Article R421-60

Dans les limites et conditions fixées par les dispositions législatives et réglementaires mentionnées à l’article L. 421-10 et aux articles R. 421-58 et R. 421-59, le fonds de garantie prend en charge les indemnités dues aux victimes d’accidents survenus dans les territoires mentionnés à l’article R. 421-58.

Toutefois, ne sont pas pris en charge :

a) Les dommages causés par des véhicules terrestres à moteur pour lesquels l’assurance en matière de circulation n’est pas obligatoire au regard de la réglementation de ces territoires ;

b) Les dommages causés par un auteur identifié ayant satisfait à l’obligation d’assurance en vigueur dans le territoire considéré et qui ne seraient pas supportés par le fonds de garantie en métropole lorsque l’obligation d’assurance y a été respectée.

Des dérogations aux dispositions du b ci-dessus peuvent être admises par arrêté conjoint du ministre chargé des départements et territoires d’outre-mer et du ministre de l’économie et des finances, en fonction des conditions particulières de la circulation automobile ou du régime d’indemnisation des victimes d’accidents automobiles dans les territoires d’outre-mer susmentionnés.

La prise en charge du fonds de garantie ne s’applique qu’aux conséquences d’accidents survenus après la date d’entrée en vigueur prévue par l’article R. 421-63.
