When, in application of the last paragraph of II of article L. 441-10 , a member’s rights are converted into an immediate or deferred life annuity expressed in euros and managed outside the auxiliary allocation accounts set up for the agreement concerned :
1° The amount of this annuity is calculated on the basis of the number of points acquired on the date on which the changes come into force and the value of the point before the changes;
2° The constituent capital is equal to the probable present value of the annuity units acquired by the insured, calculated using the mortality tables and the relevant risk-free rate curve used to calculate the best estimate provided for in Article R. 351-2;
3° The technical rate of this annuity is the single rate that leads to the same constitutive capital calculated using the same mortality table.
