Article R4433-2 of the French General Code of Local Authorities

The report, the organisation of which is decided by the region, department or local authority, includes the following elements:

1° The fundamental guidelines provided for in the first paragraph of Article L. 4433-7. These fundamental guidelines may, where appropriate, correspond to the implementation of the strategic vision that the region, department or local authority has for the sustainable development of its territory over a longer timeframe than that of the regional development plan;

2° The spatial planning principles that result from the fundamental guidelines, the locations, preferential locations, objectives and principles provided for in the areas of competence of the plan by the second to fourth paragraphs of Article L. 4433-7 as well as the rules which contribute to implementing and achieving them;

3° The individualised chapters provided for in articles L. 4433-7-1 to L. 4433-7-4. Under this heading:

a) The individualised chapter provided for in article L. 4433-7-1 applies articles R. 371-16 to R. 371-21 of the Environment Code. The system for monitoring and evaluating the regional development plan includes, in particular, indicators relating to the application of the guidelines and rules designed to preserve and restore ecological continuity;

b) The individualised chapter provided for in Article L. 4433-7-3 is based on an inventory of atmospheric pollutant and greenhouse gas emissions, an energy balance, an assessment of energy, renewable and recovery potential, an inventory of all heating networks, an assessment of possible improvements in energy efficiency, a study of the territory’s vulnerability to climate change and an assessment of air quality and its effects on public health and the environment carried out at territorial level and taking into account economic and social aspects. In terms of mitigating climate change, it sets targets at regional level for 2030 and 2050 for reducing energy consumption, preserving and increasing the absorption of carbon by soils and natural environments, and reducing greenhouse gas emissions. It defines, in terms of preventing and reducing atmospheric pollution, for the territory, targets for reducing emissions of atmospheric pollutants that are at least as demanding as those provided for at national level in application of article L. 222-9 of the Environment Code.

Article R4433-2

Le rapport, dont l’organisation est décidée par la région, le département ou la collectivité, comporte les éléments suivants :

1° Les orientations fondamentales prévues par le premier alinéa de l’article L. 4433-7. Ces orientations fondamentales peuvent, le cas échéant, correspondre à la mise en œuvre de la vision stratégique qu’a la région, le département ou la collectivité du développement durable de son territoire à un horizon plus éloigné que celui du schéma d’aménagement régional ;

2° Les principes de l’aménagement de l’espace qui résultent des orientations fondamentales, les implantations, localisations préférentielles, objectifs et principes prévus dans les domaines de compétence du schéma par les deuxième à quatrième alinéas de l’article L. 4433-7 ainsi que les règles qui contribuent à les mettre en œuvre et à les atteindre ;

3° Les chapitres individualisés prévus aux articles L. 4433-7-1 à L. 4433-7-4. A ce titre :

a) Le chapitre individualisé prévu à l’article L. 4433-7-1 fait application des articles R. 371-16 à R. 371-21 du code de l’environnement. Le dispositif de suivi et d’évaluation du schéma d’aménagement régional comprend notamment des indicateurs relatifs à l’application des orientations et règles destinées à préserver et à remettre en bon état les continuités écologiques ;

b) Le chapitre individualisé prévu à l’article L. 4433-7-3 s’appuie sur un inventaire des émissions de polluants atmosphériques et de gaz à effet de serre, un bilan énergétique, une évaluation du potentiel énergétique, renouvelable et de récupération, un recensement de l’ensemble des réseaux de chaleur, une évaluation des améliorations possibles en matière d’efficacité énergétique, une étude de vulnérabilité du territoire au changement climatique ainsi que sur une évaluation de la qualité de l’air et de ses effets sur la santé publique et l’environnement menés à l’échelon du territoire et prenant en compte les aspects économiques ainsi que sociaux. Il fixe, en matière d’atténuation du changement climatique, à l’échelon du territoire et aux horizons 2030 et 2050, les objectifs en matière de réduction de la consommation énergétique, de préservation et d’accroissement de l’absorption du carbone par les sols et les milieux naturels et de réduction des émissions de gaz à effet de serre. Il définit, en matière de prévention et de réduction de la pollution atmosphérique, pour le territoire, des objectifs de réduction des émissions de polluants atmosphériques au moins aussi exigeants que ceux prévus au niveau national en application de l’article L. 222-9 du code de l’environnement.
