Article R4437-2 of the French General Code of Local Authorities

I. – The following provisions of Part Four of this Code shall not apply to Mayotte:

1° Book I, except for the provisions mentioned in this chapter;

2° Title III of Book II;

3° In Book III:

a) Chapter I of Title I;

b) Articles R. 4312-1 à R. 4312-3 and articles R. 4312-5 to R. 4312-9 ;

c) Title II;

d) Chapters I, III and IV of Title III and Sections 2 and 3 of Chapter II of the same title;

e) Title IV;

4° In Book IV:

a) Chapter I and Section 1 of Chapter II of Title III;

b) Articles R. 4432-1 to R. 4432-7, R. 4432-13 and R. 4432-14 ;

c) Section 2 of Chapter IV of Title III.

II. – Articles R. 4313-1 to R. 4313-4 are applicable to Mayotte subject to the following reservations:

1° Pour l’application à Mayotte du 6° de l’article R. 4313-2, the reference to article L. 4332-8 is replaced by the reference to article L. 3334-6;

2° Pour l’application à Mayotte du 2° de l’article R. 4313-3, the words: “depreciation and” are deleted.

Article R4437-2

I. – Ne sont pas applicables à Mayotte les dispositions suivantes de la quatrième partie du présent code :

1° Le livre Ier, sauf les dispositions mentionnées au présent chapitre ;

2° Le titre III du livre II ;

3° Au livre III :

a) Le chapitre Ier du titre Ier ;

b) Les articles R. 4312-1 à R. 4312-3 et les articles R. 4312-5 à R. 4312-9 ;

c) Le titre II ;

d) Les chapitres Ier, III et IV du titre III et les sections 2 et 3 du chapitre II du même titre ;

e) Le titre IV ;

4° Au livre IV :

a) Le chapitre Ier et la section 1 du chapitre II du titre III ;

b) Les articles R. 4432-1 à R. 4432-7, R. 4432-13 et R. 4432-14 ;

c) La section 2 du chapitre IV du titre III.

II. – Les articles R. 4313-1 à R. 4313-4 sont applicables à Mayotte sous les réserves suivantes :

1° Pour l’application à Mayotte du 6° de l’article R. 4313-2, la référence à l’article L. 4332-8 est remplacée par la référence à l’article L. 3334-6 ;

2° Pour l’application à Mayotte du 2° de l’article R. 4313-3, les mots : ” des dépréciations et ” sont supprimés.
