Article R452-1 of the French Consumer Code

Holding for sale or distribution free of charge, offering for sale, selling or distributing free of charge products whose importation is prohibited, in disregard of the provisions of article L. 422-2, is punishable by the fine provided for 5th class offences.

Natural or legal persons guilty of the contravention provided for in the previous paragraph shall also incur the additional penalty of confiscation of the thing that served or was intended to commit the offence or of the thing that is the product thereof in accordance with the provisions of 5° of article 131-16 and of the last paragraph of Article 131-40 of the Criminal Code.

Recidivism is punishable in accordance with articles 132-11 and 132-15 du code pénal.

Article R452-1

Le fait de détenir en vue de la vente ou de la distribution à titre gratuit, de mettre en vente, de vendre, de distribuer à titre gratuit les produits dont l’importation est prohibée, en méconnaissance des dispositions de l’article L. 422-2, est puni de la peine d’amende prévue pour les contraventions de la 5e classe.

Les personnes physiques ou morales coupables de la contravention prévue au précédent alinéa encourent également la peine complémentaire de confiscation de la chose qui a servi ou était destinée à commettre l’infraction ou de la chose qui en est le produit conformément aux dispositions du 5° de l’article 131-16 et du dernier alinéa de l’article 131-40 du code pénal.

La récidive est réprimée conformément aux articles 132-11 et 132-15 du code pénal.
