Article R452-4 of the French Consumer Code

Natural persons guilty of the offence punishable by articles R. 452-3 and R. 452-3-1 are also liable to confiscation of the item that was used or intended to be used to commit the offence or of the item that is the product of the offence.
Corporate entities held criminally liable, under the conditions set out in Article 121-2 of the Criminal Code, for the offence punishable by Articles R. 452-3 and R. 452-3-1 shall incur, in addition to a fine in accordance with the terms of article 131-41 of the Penal Code, the penalty of confiscation of the thing that was used or intended to be used to commit the offence or of the thing that is the product of the offence.

Article R452-4

Les personnes physiques coupables de l’infraction réprimée par les articles R. 452-3 et R. 452-3-1 encourent également la confiscation de la chose qui a servi ou était destinée à commettre l’infraction ou de la chose qui en est le produit.
Les personnes morales déclarées responsables pénalement, dans les conditions prévues par l’article 121-2 du code pénal, de l’infraction réprimée par les articles R. 452-3 et R. 452-3-1 encourent, outre l’amende suivant les modalités prévues par l’article 131-41 du code pénal, la peine de confiscation de la chose qui a servi ou était destinée à commettre l’infraction ou de la chose qui en est le produit.
