Article R4624-45-3 of the French Labour Code

The occupational health medical file provided for in Article L. 4624-8 is compiled in secure digital format, for each worker benefiting from individual monitoring of his state of health in an occupational health and prevention service, by the occupational health professionals mentioned in the first paragraph of Article L. 4624-1.

The data processing thus implemented is placed under the responsibility of the occupational health and prevention service for compliance with the legal obligations to which it is subject, in accordance with c of 1 of Article 6 of Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

Le dossier médical en santé au travail prévu à l’article L. 4624-8 est constitué sous format numérique sécurisé, pour chaque travailleur bénéficiant d’un suivi individuel de son état de santé dans un service de prévention et de santé au travail, par les professionnels de santé au travail mentionnés au premier alinéa de l’article L. 4624-1.

Le traitement de données ainsi mis en œuvre est placé sous la responsabilité du service de prévention et de santé au travail pour le respect des obligations légales auxquelles il est soumis, conformément au c du 1 de l’article 6 du règlement (UE) 2016/679 du 27 avril 2016 relatif à la protection des personnes physiques à l’égard du traitement des données à caractère personnel et à la libre circulation de ces données.
