Article R4626-33 of the French Labour Code

An occupational health medical file is compiled by the occupational physician under the conditions set out in article L. 4624-8 of the French Labour Code.

In compliance with the provisions of articles L. 1110-4 and L. 1111-7 of the Public Health Code, the occupational health physician gathers and updates, together with the employee and the departments concerned, the administrative, medical and professional information required for individual and collective occupational health actions. This data is kept in the occupational health medical file. The same applies to the opinions of the various medical bodies formulated in application of Book VIII of the General Civil Service Code.

When the employee leaves the establishment, his medical file is transmitted under the conditions provided for in Article R. 4624-45-7. If the employee objects to his medical file being forwarded, only the list of vaccinations given and the results of tuberculin tests are forwarded.

Un dossier médical en santé au travail est constitué par le médecin du travail dans les conditions prévues à l’article L. 4624-8 du code du travail.

Dans le respect des dispositions prévues aux articles L. 1110-4 et L. 1111-7 du code de la santé publique, le médecin du travail recueille et actualise avec l’agent et les services concernés les informations administratives, médicales et professionnelles nécessaires aux actions individuelles et collectives en santé au travail. Ces données sont conservées dans le dossier médical en santé au travail. Il en est de même des avis des différentes instances médicales formulés en application du livre VIII du code général de la fonction publique.

Lorsque l’agent quitte l’établissement, son dossier médical est transmis dans les conditions prévues à l’article R. 4624-45-7. Dans le cas où l’agent s’oppose à la transmission de son dossier médical, seuls la liste des vaccinations pratiquées et les résultats des tests tuberculiniques sont transmis.
