Article R4626-35 of the French Labour Code

At the end of each of the medical examinations provided for in sub-section 2 of section 4, with the exception of the pre-resumption examination referred to in article R. 4626-29-1, the occupational health physician will draw up a medical fitness sheet in triplicate.

He will give one copy to the employee, file one copy in his occupational health medical file and send the third copy to the employer by any means giving a date certain, who will keep it in the employee’s administrative file. This copy shall be presented at any time, at their request, to the labour inspector and the labour medical inspector.

This form does not contain any information on the nature of the illnesses from which the employee is or may have been suffering. It only mentions contraindications and recommendations concerning possible assignment to certain workstations.

Le médecin du travail établit, à l’issue de chacun des examens médicaux prévus à la sous-section 2 de la section 4, à l’exception de l’examen de pré-reprise mentionné à l’article R. 4626-29-1, une fiche médicale d’aptitude en triple exemplaire.

Il en remet un exemplaire à l’agent, classe un exemplaire dans son dossier médical en santé au travail et transmet le troisième à l’employeur par tout moyen conférant date certaine, qui le conserve dans le dossier administratif de l’agent. Cet exemplaire est présenté, à tout moment, sur leur demande, à l’inspecteur du travail et au médecin inspecteur du travail.

Cette fiche ne contient aucun renseignement sur la nature des affections dont l’agent serait ou aurait été atteint. Elle mentionne uniquement les contre-indications et les recommandations concernant l’affectation éventuelle à certains postes de travail.
