Article R4641-21 of the French Labour Code

The Regional Occupational Health and Prevention Committee provides guidance in the fields of occupational health and safety and the improvement of working conditions within the region. In addition to the tasks set out in article L. 4641-5, it :

1° Issue an opinion on any issue of a strategic nature in the field of occupational health, working conditions and occupational risks which is referred to it;

2° Participate in the preparation of the territorial diagnosis relating to occupational health, working conditions and the prevention of occupational risks;

3° Promote the coordination of the guidelines and positions adopted in the main regional joint bodies in the field of occupational health, in line with the guidelines of the national occupational health and prevention committee referred to in article L. 4641-2-1;

4° Submits an annual report on its activities to the National Occupational Health and Prevention Committee.

It issues an opinion, which it submits to the Comité régional d’orientation des conditions de travail:

a) On the content of the multi-year contracts for objectives and resources of the occupational health services provided for in article L. 4622-10 ;

b) On the regional accreditation policy provided for in article D. 4622-53.

Within its area of competence, the regional occupational health and prevention committee may, on its own initiative, submit proposals and opinions and commission analyses or studies.

Article R4641-21

Le comité régional de prévention et de santé au travail exerce une fonction d’orientation dans les domaines de la santé et de la sécurité au travail et de l’amélioration des conditions de travail dans le ressort de la région. En complément des missions prévues à l’article L. 4641-5, il :

1° Rend un avis sur toute question de nature stratégique dans le domaine de la santé au travail, des conditions de travail et des risques professionnels dont il se saisit ;

2° Participe à l’élaboration du diagnostic territorial portant sur la santé au travail, les conditions de travail et la prévention des risques professionnels ;

3° Favorise la coordination des orientations et des positions prises adoptées dans les principales instances paritaires régionale dans le champ de la santé au travail, en cohérence avec les orientations du comité national de prévention et de santé au travail mentionné à l’article L. 4641-2-1 ;

4° Adresse au comité national de prévention et de santé au travail un bilan annuel de son activité.

Il rend un avis, qu’il remet au comité régional d’orientation des conditions de travail :

a) Sur le contenu des contrats pluriannuels d’objectifs et de moyens des services de santé au travail prévus à l’article L. 4622-10 ;

b) Sur la politique régionale d’agrément prévue à l’article D. 4622-53.

Dans le cadre de son domaine de compétence, le comité régional de prévention et de santé au travail peut, de sa propre initiative, soumettre des propositions et des avis et diligenter des analyses ou des études.
