When a product is rapidly alterable, when its value, its nature, the too small quantity of product or the low prevalence and distribution of the danger justifies it, sampling is carried out in a sample. This sampling results in a report being drawn up under the conditions laid down in articles R. 512-10 and R. 512-11.
All samples taken are sealed. These seals retain an identification label bearing the information mentioned in article R. 512-25.
The sample is sent by the holder, at his expense, to one of the laboratories mentioned in articles R. 512-31 and R. 512-32 designated by the authorised agent.
If the analysis establishes that the sample does not comply with the regulations, the owner or keeper is informed that he may request, at his own expense, a documentary examination by an expert offering guarantees of independence, competence and impartiality.
If the expert disagrees with the analysis, the owner or keeper is informed that he may request, at his own expense, a documentary examination by an expert offering guarantees of independence, competence and impartiality.
If the expert disagrees with the laboratory’s conclusions, the owner or keeper may, at his own expense, request a new opinion from the national reference laboratory, within the meaning of Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 as amended on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules, competent in the area of analysis concerned.
