Article R5131-8 of the French Labour Code

The allowance provided for in article L. 5131-5 may be granted by the representative of the local mission or Pôle emploi, in the name and on behalf of the State, depending on the situation and needs of the person concerned during periods when the latter is not receiving, by way of remuneration for a job, work placement or other allowance, sums exceeding a total monthly amount of 300 euros.

The allowance is paid by Pôle emploi or by the Agence de services et de paiement when the application comes from a local mission. They send the minister responsible for employment and the minister responsible for public accounts the information required for statistical monitoring of the recipients of the allowance, for knowledge of the appropriations committed and for evaluation of the measure.

Le bénéfice de l’allocation prévue à l’article L. 5131-5 peut être accordé par le représentant de la mission locale ou de Pôle emploi, au nom et pour le compte de l’Etat, en fonction de la situation et des besoins de l’intéressé pendant les périodes durant lesquelles ce dernier ne perçoit pas, au titre de la rémunération d’un emploi, d’un stage ou d’une autre allocation, des sommes excédant un montant mensuel total de 300 euros.

L’allocation est versée par Pôle emploi ou par l’Agence de services et de paiement lorsque la demande émane d’une mission locale. Ils transmettent au ministre chargé de l’emploi et au ministre chargé des comptes publics les éléments d’information nécessaires au suivi statistique des bénéficiaires de l’allocation, à la connaissance des crédits engagés, ainsi qu’à l’évaluation de la mesure.
