I.- In order to verify the good repute requirements referred to in I to III and V of article L. 322-2, the body referred to in article R. 512-3 shall request a copy of bulletin no. 2 of the criminal record of the person concerned from the national criminal record database automated by a secure means of telecommunication, or its equivalent for nationals of another Member State of the European Union or another State party to the Agreement on the European Economic Area and for persons from the Wallis and Futuna Islands.
Verification of good repute based on bulletin no. 2 applies to the natural person intermediaries mentioned in 1° to 4° of I of article R. 511-2. It also applies to the partners or third parties who direct and manage the distribution activity of the legal entity intermediaries mentioned in 1° to 4° of the I of article R. 511-2 and, where applicable, where insurance mediation is carried out as an ancillary activity to their principal activity, to the person or persons within the management team to whom responsibility for this activity is delegated.
II – Employees directly responsible for distribution activities, in particular those in charge of a production office or managing a production network, must provide proof of good repute in the form of a declaration on their honour that they meet the conditions set out in I to III and V of article L. 322-2. This document is given to the employer when these employees are hired or appointed.
