Article R5141-16 of the French Labour Code

Where there is no authorised body in the département, pursuant to article L. 5141-6, the application for the repayable advance is sent to the Prefect.
The Prefect issues the applicant with an acknowledgement of receipt and makes a decision on the application within two months of the date of receipt. The applicant is notified of the decision.
If no reply is received within two months, the application is deemed to have been rejected.

Article R5141-16

Lorsqu’il n’y a pas dans le département d’organisme mandaté, en application de l’article L. 5141-6, la demande tendant à l’octroi de l’avance remboursable est adressée au préfet.
Le préfet délivre au demandeur un accusé de réception et statue sur la demande dans un délai de deux mois à compter de la date de sa réception. Sa décision est notifiée au demandeur.
En cas de non-réponse dans le délai de deux mois, la demande est réputée rejetée.
