Article R5211-3 of the French General Code of Local Authorities

For the application of the provisions of article L. 2123-2 relating to credit for hours:

1° The president, vice-presidents and members of the deliberative body of one of the public establishments for inter-municipal cooperation mentioned in articles L. 5212-1, L. 5332-1 et L. 5711-1 are, when they do not hold a municipal mandate, assimilated respectively to the mayor, deputy mayors and municipal councillors of the most populated commune of this public establishment;

2° The president, vice-presidents and members of the deliberative body of one of the public establishments of inter-communal cooperation mentioned in articles L. 5214-1, L. 5215-1, and L. 5216-1 are assimilated respectively to the mayor, deputy mayors and municipal councillors of a commune whose population would be equal to that of all the communes making up this public establishment.

Pour l’application des dispositions de l’article L. 2123-2 relatif au crédit d’heures :

1° Le président, les vice-présidents et les membres de l’organe délibérant de l’un des établissements publics de coopération intercommunale mentionnés aux articles L. 5212-1, L. 5332-1 et L. 5711-1 sont, lorsqu’ils n’exercent pas de mandat municipal, assimilés respectivement au maire, aux adjoints au maire et aux conseillers municipaux de la commune la plus peuplée de cet établissement public ;

2° Le président, les vice-présidents et les membres de l’organe délibérant de l’un des établissements publics de coopération intercommunale mentionnés aux articles L. 5214-1, L. 5215-1, et L. 5216-1 sont assimilés respectivement au maire, aux adjoints au maire et aux conseillers municipaux d’une commune dont la population serait égale à celle de l’ensemble des communes composant cet établissement public.
