Article R5422-5 of the French Labour Code

In order to fulfil their obligation to register as defined in article L. 5422-13, employers who take on an employee for the first time and are required to insure them against the risk of loss of employment must send a registration form to Pôle emploi (1).

He is deemed to have fulfilled this obligation by completing the declaration referred to in article L. 1221-16 (2).

Regardless of the date on which the affiliation form is received by the body (3), affiliation takes effect on the date on which the first employee is recruited.

Pour satisfaire à son obligation d’affiliation définie à l’article L. 5422-13, l’employeur qui embauche pour la première fois un salarié qu’il est tenu d’assurer contre le risque de privation d’emploi, adresse un bordereau d’affiliation à Pôle emploi (1).

Il est réputé s’être acquitté de cette obligation par l’accomplissement de la déclaration mentionnée à l’article L. 1221-16 (2).

Quelle que soit la date à laquelle le bordereau d’affiliation est reçu par l’organisme (3), l’affiliation prend effet à la date d’embauche du premier salarié.
