Article R552-15 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the application of the first paragraph of article L. 552-15, if a person remains in the accommodation after the date mentioned in article R. 552-12 or, where applicable, after the expiry of the period stipulated in article R. 552-13, the Prefect of the département in which the accommodation is located or the manager of the accommodation shall give the person concerned formal notice to leave the premises in the following cases:
1° The person does not have a residence permit and has not applied for assisted voluntary return or has refused the offer of assisted voluntary return made to them by the French Office for Immigration and Integration;
2° The person has a residence permit in France and has refused one or more offers of housing or accommodation made to them with a view to vacating the accommodation occupied.
If the formal notice is unsuccessful, the prefect or the manager of the accommodation may, after a final rejection decision and under the conditions set out in article L. 552-15, refer the matter to the president of the administrative court in order to enjoin the occupant to leave the premises.

Article R552-15

Pour l’application du premier alinéa de l’article L. 552-15, si une personne se maintient dans le lieu d’hébergement après la date mentionnée à l’article R. 552-12 ou, le cas échéant, après l’expiration du délai prévu à l’article R. 552-13, le préfet du département dans lequel se situe ce lieu d’hébergement ou le gestionnaire du lieu d’hébergement met en demeure cette personne de quitter les lieux dans les cas suivants :
1° La personne ne dispose pas d’un titre de séjour et n’a pas sollicité d’aide au retour volontaire ou a refusé l’offre d’aide au retour volontaire qui lui a été présentée par l’Office français de l’immigration et de l’intégration ;
2° La personne bénéficie d’un titre de séjour en France et a refusé une ou plusieurs offres de logement ou d’hébergement qui lui ont été faites en vue de libérer le lieu d’hébergement occupé.
Si la mise en demeure est infructueuse, le préfet ou le gestionnaire du lieu d’hébergement peut, après une décision de rejet définitive et dans les conditions prévues à l’article L. 552-15, saisir le président du tribunal administratif afin d’enjoindre à cet occupant de quitter les lieux.
