Article R581-8 of the French Code governing the entry and residence of foreign nationals and the right of asylum

A foreign national admitted to reside in France under temporary protection may apply to be joined by a member of his or her family who is benefiting from temporary protection in another Member State of the European Union.
Where the application concerns the spouse of the foreign national admitted to reside in France, his or her minor children or those of his or her spouse, the préfet de département and, in Paris, the préfet de police accepts it in accordance with the respective reception capacities of the Member States concerned and subject to the foreign national providing proof of his or her family’s consent. In other cases, the Préfet de département and, in Paris, the Préfet de police will take a decision based on reception capacity and taking into account the grounds of necessity and urgency put forward by the persons concerned.

L’étranger admis au séjour en France au titre de la protection temporaire peut demander à être rejoint par un membre de sa famille qui bénéficie de la protection temporaire dans un autre Etat membre de l’Union européenne.
Lorsque la demande concerne le conjoint de l’étranger admis au séjour en France, ses enfants mineurs ou ceux de son conjoint, le préfet de département et, à Paris, le préfet de police l’accepte en fonction des capacités d’accueil respectives des Etats membres intéressés et sous réserve que cet étranger justifie du consentement de sa famille. Dans les autres cas, le préfet de département et, à Paris, le préfet de police statue en fonction des capacités d’accueil et en tenant compte des motifs de nécessité et d’urgence invoqués par les intéressés.
