Article R611-21 of the French Intellectual Property Code

Inventions whose author is an inventor covered by article L. 611-7-1, hosted by a legal entity carrying out research in which, at the date of the invention declaration, at least half of the permanent research staff are private-law employees, are subject to the provisions of articles R. 611-1 to R. 611-10.

The conditions under which this inventor, the author of an invention belonging to the legal entity carrying out research which hosts him pursuant to 1° of article L. 611-7-1, benefits from financial compensation are determined by his hosting agreement.

In particular, the amount of financial compensation received by the inventor takes account of the tasks entrusted to him, the circumstances in which the invention was made, the practical difficulties involved in developing it, his personal contribution to the invention and the economic and commercial interest that the host structure may derive from it.

Les inventions dont l’auteur est un inventeur relevant de l’article L. 611-7-1, accueilli par une personne morale réalisant de la recherche dont, à la date de la déclaration d’invention, la moitié au moins des personnels permanents de recherche sont des salariés de droit privé, sont soumises aux dispositions des articles R. 611-1 à R. 611-10.

Les conditions dans lesquelles cet inventeur, auteur d’une invention appartenant à la personne morale réalisant de la recherche qui l’accueille en application du 1° de l’article L. 611-7-1, bénéficie d’une contrepartie financière sont déterminées par sa convention d’accueil.

En particulier, le montant de la contrepartie financière dont bénéficie cet inventeur tient compte des missions qui lui sont confiées, des circonstances de réalisation de l’invention, des difficultés pratiques de mise au point, de sa contribution personnelle à l’invention et de l’intérêt économique et commercial que la structure d’accueil pourra en retirer.
