Article R6112-5 of the French Public Health Code

I.-When an institution is designated by the Director General of the Regional Health Agency to carry out one of the actions mentioned in 1°, 2° and 3° of III of Article L. 6112-2, its multiannual contract of objectives and resources is the subject of an amendment in order to specify the expected action and the terms and conditions of its implementation.

II – Pursuant to 4° of III of Article L. 6112-2, the establishment must notify the Regional Health Agency of any plans to cease or modify its healthcare activities that are likely to restrict the supply of healthcare services no later than six months before they are implemented. The agency, in conjunction with the establishment concerned, shall implement measures to ensure that the health needs of the population continue to be met.

I.-Lorsqu’un établissement est désigné par le directeur général de l’agence régionale de santé pour réaliser l’une des actions mentionnées aux 1°, 2° et 3° du III de l’article L. 6112-2, son contrat pluriannuel d’objectifs et de moyens fait l’objet d’un avenant afin de préciser l’action attendue et les modalités de sa mise en œuvre.

II.-En application du 4° du III de l’article L. 6112-2, l’établissement communique à l’agence régionale de santé son projet de cessation ou de modification de ses activités de soins susceptible de restreindre l’offre de services de santé au plus tard six mois avant sa réalisation. L’agence, en lien avec l’établissement concerné, met en œuvre les mesures permettant de garantir le maintien d’une réponse aux besoins de santé de la population.
