Article R6123-91-1 of the French Public Health Code

Authorisation may only be granted if the applicant:

1° Has an organisation, set up where appropriate jointly with other cancer treatment authorisation holders, which ensures that each patient is informed of the diagnosis and of a therapeutic proposal based on multidisciplinary consultation in accordance with the care guidelines defined by the Institut National du Cancer in application of 2° of Article L. 1415-2 and set out in a personalised care programme given to the patient;

2° Ensures the organisation of the multidisciplinary consultations mentioned in 1°. When the applicant or the holder of the cancer treatment activity does not carry out all of the cancer treatment modalities and therapeutic procedures mentioned respectively in article R. 6123-86-1 and in 1° of article R. 6123-90-2, the multidisciplinary consultation is organised with other holders of the authorisation carrying out at least the cancer treatment modalities mentioned in article R. 6123-86-1.

Article R6123-91-1

L’autorisation ne peut être accordée que si le demandeur :

1° Dispose d’une organisation, mise en place le cas échéant conjointement avec d’autres titulaires d’une autorisation de traitement du cancer, qui assure à chaque patient l’annonce du diagnostic et d’une proposition thérapeutique fondée sur une concertation pluridisciplinaire selon des modalités conformes aux référentiels de prise en charge définis par l’Institut national du cancer en application du 2° de l’article L. 1415-2 et traduite dans un programme personnalisé de soins remis au patient ;

2° Assure l’organisation des concertations pluridisciplinaires mentionnées au 1°. Lorsque le demandeur ou le titulaire de l’activité de soins de traitement du cancer n’exerce pas l’ensemble des modalités de traitement du cancer et des actes thérapeutiques respectivement mentionnés à l’article R. 6123-86-1 et au 1° de l’article R. 6123-90-2, la concertation pluridisciplinaire est organisée avec d’autres titulaires de l’autorisation exerçant au moins les modalités de traitement du cancer mentionnées à l’article R. 6123-86-1.
