Article R6123-92-1 of the French Public Health Code

Authorisation for surgical oncology in children and adolescents under the age of eighteen with a C rating may only be granted if the applicant or holder is also authorised for the systemic drug treatment of cancer in children and adolescents under the age of eighteen.

However, by way of derogation from the provisions of the first paragraph, in the event of a shortfall identified in the regional health plan, authorisation may exceptionally be granted to an applicant who is not authorised for the systemic drug treatment of cancer and who provides oncology surgery on his site, possibly for a single tumour site, if this is necessary for the treatment of cancer in children.

L’autorisation de chirurgie oncologique chez l’enfant et l’adolescent de moins de dix-huit ans avec la mention C ne peut être accordée que si le demandeur ou le titulaire est également autorisé à la modalité de traitements médicamenteux systémiques du cancer chez l’enfant et l’adolescent de moins de dix-huit ans.

Toutefois, par dérogation aux dispositions du premier alinéa, en cas de carence constatée dans le schéma régional de santé, l’autorisation peut exceptionnellement être accordée à un demandeur non autorisé à la modalité de traitements médicamenteux systémiques du cancer qui dispense sur son site une chirurgie oncologique, le cas échéant pour une unique localisation de tumeurs, si celle-ci est nécessaire à la prise en charge du cancer chez l’enfant.
