Article R6123-97 of the French Public Health Code

The authorisation provided for in article L. 6122-1 may only be issued to a health establishment or a health cooperation grouping if it has the following facilities on the same site, possibly by agreement with another establishment located on this site, in a common building or failing that in neighbouring buildings:

1° A full-time inpatient unit and protected operating theatres for neurosurgical patients;

2° An intensive care unit authorised under either 1° of article R. 6123-34-1, or 1° or 2° of article R. 6123-34-2;

3° An imaging technical platform enabling neuroradiology examinations to be carried out.

The authorisation specifies the site where the activity is carried out. Only one authorisation may be issued per site.

Article R6123-97

L’autorisation prévue par l’article L. 6122-1 ne peut être délivrée à un établissement de santé ou à un groupement de coopération sanitaire que s’il dispose sur un même site, éventuellement par convention avec un autre établissement implanté sur ce site, dans un bâtiment commun ou à défaut dans des bâtiments voisins, des moyens suivants :

1° Une unité d’hospitalisation à temps complet et des salles d’intervention protégées prenant en charge les patients de neurochirurgie ;

2° Une unité de réanimation autorisée au titre soit du 1° de l’article R. 6123-34-1, soit des 1° ou 2° de l’article R. 6123-34-2 ;

3° Un plateau technique d’imagerie permettant de pratiquer des examens de neuroradiologie.

L’autorisation précise le site sur lequel l’activité est exercée. Il ne peut être délivré qu’une autorisation par site.
