Article R615-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative authority may, pursuant to 2° of Article L. 615-1, decide to implement an enforceable expulsion decision taken by one of the other Member States of the European Union, the Republic of Iceland, the Principality of Liechtenstein, the Kingdom of Norway or the Swiss Confederation, where this decision is based:
1° On a serious and present threat to public order or national security and taken by one of these States in one of the following cases:
a) where the foreign national has been convicted by the State which issued the residence permit, of an offence punishable by a custodial sentence of at least one year ;
b) where there are serious grounds for believing that the foreign national has committed serious criminal offences or there are real indications that he is planning to commit such offences in the territory of one of the States mentioned in the first paragraph;
2° On failure to comply with national regulations relating to the entry or residence of foreign nationals, in the State which issued the expulsion decision.
The decision mentioned in this article is applicable without prejudice to the surrender decision provided for in Article L. 621-4 and the transfer decision provided for in Article L. 572-1.

Article R615-2

L’autorité administrative peut, en application du 2° de l’article L. 615-1, décider de mettre en œuvre une décision d’éloignement exécutoire prise par l’un des autres Etats membres de l’Union européenne, la République d’Islande, la Principauté du Liechtenstein, le Royaume de Norvège ou la Confédération suisse, lorsque cette décision est fondée :
1° Sur une menace grave et actuelle pour l’ordre public ou la sécurité nationale et prise par l’un de ces Etats dans l’un des cas suivants :
a) lorsque l’étranger a fait l’objet d’une condamnation par l’Etat qui lui a délivré un titre de séjour, pour une infraction passible d’une peine privative de liberté d’au moins un an ;
b) lorsqu’il existe des raisons sérieuses de croire que l’étranger a commis des faits punissables graves ou des indices réels qu’il envisage de commettre de tels faits sur le territoire d’un des Etats mentionnés au premier alinéa ;
2° Sur le non-respect de la réglementation nationale, relative à l’entrée ou au séjour des étrangers, de l’Etat qui a édicté cette décision d’éloignement.
La décision mentionnée au présent article est applicable sans préjudice de la décision de remise prévue à l’article L. 621-4 et de la décision de transfert prévue à l’article L. 572-1.
