Article R632-9 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The expulsion decision may be revoked at any time by the authority that took it.
The revocation of an expulsion decision taken, prior to the entry into force of decree no. 97-24 of 13 January 1997, by the Minister of the Interior, on the basis of the provisions of article 23 of order no. 45-2658 of 2 November 1945, now codified in article L. 631-1, and after completion of the formalities provided for in article 24 of the same order, now codified in article L. 632-1, falls within the jurisdiction of the Prefect of the département in which the foreign national was resident on the date of the expulsion order. In Paris, the competent prefect is the prefect of the police.

La décision d’expulsion peut à tout moment être abrogée par l’autorité qui l’a prise.
L’abrogation d’une décision d’expulsion prise, avant l’entrée en vigueur du décret n° 97-24 du 13 janvier 1997, par le ministre de l’intérieur, sur le fondement des dispositions de l’article 23 de l’ordonnance n° 45-2658 du 2 novembre 1945, désormais codifiées à l’article L. 631-1, et après accomplissement des formalités prévues par les dispositions de l’article 24 de la même ordonnance, désormais codifiées à l’article L. 632-1, relève de la compétence du préfet du département dans le ressort duquel l’étranger avait sa résidence à la date de l’arrêté d’expulsion. A Paris, le préfet compétent est le préfet de police.
