Article R6332-21 of the French Labour Code

If the agreement on objectives and resources referred to in article L. 6332-2 is not concluded, the expenditure referred to in article R. 6332-17 may not exceed the minimum amount referred to in the third paragraph of I of article D. 6332-18.

Article R6332-21

En cas d’absence de conclusion de la convention d’objectifs et de moyens mentionnée à l’article L. 6332-2, les dépenses mentionnées à l’article R. 6332-17 ne peuvent excéder le minimum mentionné au troisième alinéa du I de l’article D. 6332-18.
