Article R6332-26 of the French Labour Code

I.-Skills operators ensure that the training actions mentioned in article L. 6313-1 are carried out as part of a control of services rendered.

II – The control referred to in I is carried out with regard to the supporting documents defined by an order of the minister responsible for vocational training.

In the event of an anomaly being noted in the implementation of an action mentioned in 1° to 3° of article L. 6313-1, the skills operator may ask the body providing the training or the employer for any additional documents needed to ensure that the action it is financing is actually taking place and that it complies with the legal, regulatory and contractual provisions.

III -Where the training provider or the employer does not provide all of the documents provided for or requested in application of II, the skills operator will not pay the expenses relating to the actions defined in article L. 6313-1.

IV -Skills operators make all necessary and substantiated reports to the government departments responsible for monitoring vocational training.

In the event of an anomaly being observed in the performance of an apprenticeship contract, the skills operators report the matter to the State departments responsible for monitoring vocational training and to the departments responsible for monitoring teaching mentioned in the last paragraph of article L. 6211-2.

I.-Les opérateurs de compétences s’assurent de l’exécution des actions de formation mentionnées à l’article L. 6313-1 dans le cadre d’un contrôle de service fait.

II.-Le contrôle mentionné au I s’effectue au regard des pièces justificatives définies par un arrêté du ministre chargé de la formation professionnelle.

En cas d’anomalie constatée dans l’exécution d’une action mentionnée aux 1° à 3° de l’article L. 6313-1, l’opérateur de compétences peut demander à l’organisme prestataire de formation ou à l’employeur tout document complémentaire nécessaire pour s’assurer de la réalité de l’action qu’il finance et de sa conformité aux dispositions légales, réglementaires et conventionnelles.

III.-Lorsque le prestataire de formation ou l’employeur ne fournissent pas l’ensemble des pièces prévues ou demandées en application du II, l’opérateur de compétences ne prend pas en charge les dépenses liées aux actions définies à l’article L. 6313-1.

IV.-Les opérateurs de compétences effectuent tout signalement utile et étayé auprès des services de l’Etat chargés du contrôle de la formation professionnelle.

En cas d’anomalie constatée dans l’exécution d’un contrat d’apprentissage, les opérateurs de compétences effectuent un signalement auprès des services de l’Etat chargés du contrôle de la formation professionnelle et auprès des services chargés du contrôle pédagogique mentionnés au dernier alinéa de l’article L. 6211-2.
