Article R6333-6 of the French Labour Code

When the Caisse des dépôts et consignations finds that one of the service providers mentioned in article L. 6351-1 has failed to meet the commitments it has entered into, it may, depending on the nature of the failure, issue a warning, refuse payment of services, demand reimbursement of sums it has unduly paid and temporarily suspend its listing on the dematerialised service mentioned in article L. 6323-9. These measures, which are proportionate to the breaches observed, are taken after an adversarial procedure has been followed and in accordance with the terms and conditions specified in the general terms and conditions of use of the electronic service.

Caisse des Dépôts et Consignations shall report any breaches it observes to the competent State authorities in a useful and substantiated manner.

Lorsque la Caisse des dépôts et consignations constate un manquement de l’un des prestataires mentionnés à l’article L. 6351-1 aux engagements qu’il a souscrits, elle peut, selon la nature du manquement, lui prononcer un avertissement, refuser le paiement des prestations, demander le remboursement des sommes qu’elle lui a indûment versées et suspendre temporairement son référencement sur le service dématérialisé mentionné à l’article L. 6323-9. Ces mesures, proportionnées aux manquements constatés, sont prises après application d’une procédure contradictoire et selon des modalités que les conditions générales d’utilisation du service dématérialisé précisent.

La Caisse des dépôts et consignations effectue tout signalement utile et étayé des manquements qu’elle constate auprès des autorités compétentes de l’Etat.
