In application of Article L. 642-22-1, transfers of businesses and realisations of assets are publicised by the mandataires de justice by means of a computer service accessible via the internet.
Any transfer of a business is publicised in the press. Its scope is defined by the juge-commissaire. The juge-commissaire shall determine whether press advertising is necessary for low-value assets.
The liquidator, or the administrator where one has been appointed, shall communicate to the court registry the essential characteristics of the business or of the branch or branches of business likely to be sold. Any interested party may consult this information at the court registry.
For the application of the second paragraph of Article L. 642-2, the court shall ensure that, taking into account the nature of the business in question, the steps taken by the mandataire ad hoc or the conciliator appointed pursuant to Articles L. 611-3 or L. 611-6 have sufficiently publicised the preparation of the transfer.
