Article R7 of the French Code of Criminal Procedure

The jury for the technical examination for judicial police officers of the national gendarmerie is composed as follows:

1° The public prosecutor at the Cour de cassation or his delegate chosen by him from among the first advocates general and advocates general at the Cour de cassation, chairman;

2° The director general of the national gendarmerie or his representative ;

3° The head of the general inspectorate of the national gendarmerie or his representative;

4° The commander of the national gendarmerie schools or his representative;

5° Active or honorary magistrates;

6° Senior officers of the national gendarmerie, no more than half of whom may be retired.

The members of the jury mentioned in 1°, 2°, 3°, 4° and 5° may be different from the members mentioned in 1°, 2°, 4°, 7° and 8° of Article R. 3.

The total number of magistrates provided for in 1° and 5° is equal to the total number of members provided for in 2°, 3°, 4° and 6°.

Magistrates and senior officers of the national gendarmerie are appointed as alternate members. The alternate member replaces the titular member before the start of the examination and for its entire duration.

The jury draws up the list of candidates who have passed the national gendarmerie judicial police officer technical examination.

In the event of a tie, the jury chairman has the casting vote.

Article R7

Le jury de l’examen technique d’officier de police judiciaire de la gendarmerie nationale est composé comme suit :

1° Le procureur général près la Cour de cassation ou son délégué choisi par lui parmi les premiers avocats généraux et les avocats généraux près la Cour de cassation, président ;

2° Le directeur général de la gendarmerie nationale ou son représentant ;

3° Le chef de l’inspection générale de la gendarmerie nationale ou son représentant ;

4° Le commandant des écoles de la gendarmerie nationale ou son représentant ;

5° Des magistrats en activité ou honoraires ;

6° Des officiers supérieurs de la gendarmerie nationale dont la moitié au plus peuvent être en retraite.

Les membres du jury mentionnés aux 1°, 2°, 3°, 4° et 5° peuvent être différents des membres mentionnés aux 1°, 2°, 4°, 7° et 8° de l’article R. 3.

Le nombre total des magistrats prévus aux 1° et 5° est égal au nombre total des membres prévus aux 2°, 3°, 4° et 6°.

Des magistrats et des officiers supérieurs de la gendarmerie nationale sont désignés comme suppléants. Le membre suppléant remplace le membre titulaire avant le début de l’examen et pour toute sa durée.

Le jury établit la liste des candidats ayant satisfait à l’examen technique d’officier de police judiciaire de la gendarmerie nationale.

En cas de partage des voix, le président du jury a voix prépondérante.
