Article R712-5 of the French Consumer Code

For the application of the provisions of 2° of article R. 712-2, the prefect appoints by decree, for a renewable period of two years, a person and his alternate whom he chooses from a departmental list, comprising four names, sent to him by the French Association of Credit Institutions and Investment Firms, as well as a person and his alternate proposed, under the same conditions, by family or consumer associations. These associations must be approved under the provisions of article L. 811-1 granted by order of the prefect of the department in which their registered office is located or are affiliated to a national association that has itself been approved.
If the prefect finds that one of these persons and his or her alternate is absent without legitimate reason from three consecutive meetings of the commission, he or she may terminate their mandate before the two-year period has expired. He will then appoint another person and an alternate chosen from the same list.

Pour l’application des dispositions du 2° de l’article R. 712-2, le préfet nomme par arrêté, pour une durée de deux ans renouvelable, une personne et son suppléant qu’il choisit sur une liste départementale, comprenant quatre noms, qui lui est transmise par l’Association française des établissements de crédit et des entreprises d’investissement, ainsi qu’une personne et son suppléant proposés, dans les mêmes conditions, par les associations familiales ou de consommateurs. Ces associations justifient d’un agrément au titre des dispositions de l’article L. 811-1 accordé par arrêté du préfet du département de leur siège social ou sont affiliées à une association nationale elle-même agréée.
Si le préfet constate l’absence de l’une de ces personnes et de son suppléant sans motif légitime à trois séances consécutives de la commission, il peut mettre fin à leur mandat avant l’expiration de la période de deux ans. Il nomme alors une autre personne et un suppléant choisis sur la même liste.
