Article R731-3 of the French Consumer Code

The amount of the household’s current expenses is assessed by the commission, either for their actual amount on the basis of items declared by the debtor, or according to the scale set by its rules of procedure and taking into account the composition of the family. The rules of procedure specify the conditions and procedures under which expenses are taken into account for their actual amount or according to the scale.
When the commission takes into account the actual amount of current household expenses, it may ask the debtor to provide supporting documents. If the debtor fails to do so, the expenses in question are assessed in accordance with the above-mentioned scale.

Le montant des dépenses courantes du ménage est apprécié par la commission, soit pour leur montant réel sur la base des éléments déclarés par le débiteur, soit en fonction du barème fixé par son règlement intérieur et prenant en compte la composition de la famille. Le règlement intérieur précise à quelles conditions et selon quelles modalités les dépenses sont prises en compte pour leur montant réel ou selon le barème.
Lorsque la commission prend en compte des dépenses courantes du ménage pour leur montant réel, elle peut demander au débiteur d’en fournir des justificatifs. Si le débiteur ne les fournit pas, les dépenses concernées sont appréciées selon le barème susvisé.
