Article R733-18 of the French Consumer Code

In the event that a debt corresponding to the amount of an unpaid cheque is written off as regularisation of the payment incident pursuant to the provisions of article L. 733-17, the account-holding institution shall notify the Banque de France of this regularisation no later than the second business day following the submission by the debtor of a certificate stating that the payment incident has been regularised following the total erasure of the corresponding debt.

When the write-off measure has been taken in application of the provisions of article L. 733-9, the certificate is drawn up by the commission, which sends it to the debtor when it sends the letter referred to in Article R. 733-8.

Where this measure has been taken pursuant to the provisions of article L. 733-13, the certificate is drawn up and sent to the debtor by the registry when the judgment provided for in Article R. 733-17 is sent.

Article R733-18

En cas d’effacement d’une créance correspondant au montant d’un chèque impayé et valant régularisation de l’incident de paiement en application des dispositions de l’article L. 733-17, l’établissement teneur de compte avise la Banque de France de cette régularisation au plus tard le deuxième jour ouvré suivant la remise par le débiteur d’une attestation précisant que l’incident de paiement est régularisé par suite de l’effacement total de la créance correspondante.

Lorsque la mesure d’effacement a été prise en application des dispositions de l’article L. 733-9, l’attestation est établie par la commission, qui l’adresse au débiteur lors de l’envoi de la lettre mentionnée à l’article R. 733-8.

Lorsque cette mesure a été prise en application des dispositions de l’article L. 733-13, l’attestation est établie et adressée au débiteur par le greffe lors de l’envoi du jugement prévu à l’article R. 733-17.
