Article R7342-15 of the French Labour Code

If it has not given a ruling within the four-month period referred to in the second paragraph of article L. 7342-10, the judicial court is relinquished of the case. In this case, the file of the proceedings is transmitted without delay by the registry of this court to the registry of the court of appeal. The court registry notifies the parties by simple letter.

On receipt of the case file, the Court of Appeal registry will summon the parties to the hearing scheduled for the proceedings. The proceedings are oral and without mandatory representation. The provisions of articles 937 to 949 of the Code of Civil Procedure apply.

Lorsqu’il n’a pas statué dans le délai de quatre mois mentionné au deuxième alinéa de l’article L. 7342-10, le tribunal judiciaire est dessaisi de l’affaire. Dans ce cas, le dossier de la procédure est transmis sans délai par le greffe de ce tribunal au greffe de la cour d’appel. Le greffe du tribunal judiciaire en avise les parties par lettre simple.


Dès réception du dossier de la procédure, le greffe de la cour d’appel convoque les parties à l’audience prévue pour les débats. La procédure est orale et sans représentation obligatoire. Il est fait application des dispositions des articles 937 à 949 du code de procédure civile.


La cour d’appel statue en premier et dernier ressort.
