Article R744-9 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Aforeign nationals may not be held in an administrative detention facility after the liberty and custody judge has extended their detention pursuant to article L. 742-3.
However, in the event of an appeal against the extension order, the foreign national may be held there until the president of the court of appeal has ruled if there is no administrative detention centre within the jurisdiction of the court of appeal.
Similarly, in the event of an appeal against the removal decision which is decided within the time limits provided for in article L. 614-9, the foreign national may be kept in the premises until the appeal has been decided if there is no detention centre within the jurisdiction of the administrative court.

L’étranger ne peut être maintenu dans un local de rétention administrative après que le juge des libertés et de la détention a prolongé sa rétention en application de l’article L. 742-3.
Toutefois, en cas d’appel de l’ordonnance de prolongation, l’étranger peut y être maintenu jusqu’à ce que le président de la cour d’appel ait statué s’il n’y a pas de centre de rétention administrative dans le ressort de la cour d’appel.
De même, en cas de recours contre la décision d’éloignement sur lequel il est statué dans les délais prévus à l’article L. 614-9, l’étranger peut être maintenu dans le local jusqu’à ce qu’il ait été statué sur le recours s’il n’y a pas de centre de rétention dans le ressort du tribunal administratif.
