Article R8115-2 of the French Labour Code

When the Regional Director of Companies, Competition, Consumption, Labour and Employment decides to impose an administrative fine, he shall inform the interested party, via the employer’s representative mentioned in II of article L. 1262-2-1 or, failing that, directly to the employer, of the amount of the fine envisaged and invite him to submit his observations within a period of fifteen days.

On expiry of the time limit and in the light of any comments made by the interested party, it will notify its decision and issue the corresponding collection order.

The proposed fine and the notification of the decision imposing the fine are made by any means capable of conferring a date certain.

Lorsque le directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi décide de prononcer une amende administrative, il indique à l’intéressé par l’intermédiaire du représentant de l’employeur mentionné au II de l’article L. 1262-2-1 ou, à défaut, directement à l’employeur, le montant de l’amende envisagée et l’invite à présenter ses observations dans un délai de quinze jours.

A l’expiration du délai fixé et au vu des observations éventuelles de l’intéressé, il notifie sa décision et émet le titre de perception correspondant.

L’indication de l’amende envisagée et la notification de la décision infligeant l’amende sont effectuées par tout moyen permettant de leur conférer date certaine.
