Article 123-3 of the French Cinema and Moving Image Code

For the allocation of automatic financial aid for the creation and modernisation of cinemas, the automatic cinema exhibition account is opened for each cinema in the name of the owner of the business or, in the absence of a business, in the name of the owner of the premises housing the cinema.
When the owner does not operate the cinema himself, he may delegate to the operator the right to invest the sums held in the account. In this case, the sums may only be invested in the modernisation of the establishment in question.

Article 123-3

Pour l’attribution des aides financières automatiques à la création et à la modernisation des établissements de spectacles cinématographiques, le compte automatique exploitation cinéma est ouvert au titre de chaque établissement, au nom du propriétaire du fonds de commerce ou, à défaut de l’existence d’un fonds de commerce, au nom du propriétaire des locaux abritant la ou les salles de l’établissement de spectacles cinématographiques.
Lorsque le propriétaire n’exploite pas lui-même l’établissement, il peut déléguer à l’exploitant le droit d’investir les sommes inscrites sur le compte dont il est titulaire. Dans ce cas, ces sommes ne peuvent être investies que pour la modernisation de l’établissement considéré.
